Higher Everyday Living Fees:自愿协议与过渡检查
卫生部 2026 年 9 月 21 日发布的公开消息称,从 2026 年 11 月 1 日起,服务商不得对住户在 2025 年 11 月 1 日前无需额外付费即可获得的服务收取 HELF。Federal Register 记录《Aged Care Amendment (September Indexation and Other Measures) Rules 2026》于 9 月 18 日注册,Aged Care Rules 2025 版本记录显示相关 compilation 自 9 月 20 日起适用。服务商应在实施记录中保留注册文书和当前官方指引,而不是只依赖早期公告。既有必需服务、住户选择与协议保护仍然适用。 2026 年 9 月 10 日,ACQSC 报告一家服务商经 HELF 收费审查后,向近 350 名住户退款或抵扣超过 19 万澳元。这是监管处理结果,不是新规,也不代表人人自动获退款。ACQSC 8 月 11 日 webinar 资料重申既有 HELF 边界,并非 8 月新规。HELF 是自愿协议,不能作为入住条件,也不能在住户入住前签订。Standing agreement 的居民有 28 天冷静期;之后任何一方可提前 28 天通知变更或终止。规则允许的不可避免成本回收与通知期分开,最长至通知期结束或终止生效后 90 天。Standing agreement 至少每 12 个月复核一次;只有每年 7 月 1 日法定 CPI-based factor 大于 1 并应用规定公式时,才可替换 agreement amount。既有 extra service 和 additional service fee 安排可过渡至 2026 年 10 月 31 日,并自 2026 年 11 月 1 日起失效。Residential Care Service List 的必需服务不能转入 HELF 收费。每项 HELF 服务必须可单独购买;bundle 可包含住户无法使用的个别项目,但须保留真实的单项选择,且住户不能比单买可用项目处于更差情况。Commission 首期投诉 newsletter 把错误 HELF 收费作为投诉例子,但不代表每项争议收费都错误,也不保证自动退款。
