NDIS 修正法首批階段性變化現已生效
《National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Act 2026》於 2026 年 8 月 20 日獲御准，並於 8 月 21 日登記。Schedule 1 Parts 1–3 和 Schedule 2 Parts 1–4 於 8 月 27 日生效。由參與者提出的 plan reassessment 現只能由參與者本人、其 plan nominee 或 child representative 使用指定表格，並附上所需資料和證據。NDIA 收到符合這些要求的請求後，有 90 天決定重新評估、不重新評估或變更計劃。Section 45B 同日起適用於 8 月 27 日或之後提出的 claims：對 NDIS provider，僅針對 NDIS Rules 指定、且與 claim 或該 claim 所涉 support 有關的記錄，預設從 claim 提出日保存 7 年；Rules 可規定較短期限。NDIA 表示更詳細的 record-keeping 指引仍將發布。由 2026 年 10 月 1 日起，新建或 reassess 的 plan 中，Social, Economic and Community Participation 與 Improved Daily Living Skills 兩類部分 budget 將下調；plan renewal 由 2027 年 2 月 1 日起適用。這不是對所有 supports 的統一削減：NDIA 列出不受影響的支援組別與日常基本支援，個別影響會因計劃而異，並宣布將為部分高支援需要參與者提供新的 variation pathway。
文件與流程複核行動
把官方變化轉成可分派的複核行動
- 分開記錄 8 月 27 日已生效的 plan reassessment 變化、Section 45B 的 claim-date 適用邊界及後續分階段日期；不要把整部修正法寫成已經全面實施。
- 協助 plan reassessment 時，確認請求人是參與者、plan nominee 或 child representative，使用指定表格和證據，並從 NDIA 收到符合要求的請求起追蹤 90 天決定期；服務商不能僅憑 consent 代為提出請求。
- 對 8 月 27 日或之後提出的 claim，先核對記錄是否屬於 Rules 指定類別及有否較短期限；不要把服務商的 7 年預設期套用於所有 progress notes 或 NDIS 文件，並把它與 12 月 1 日才開始的 90 天 claim-submission limit 分開。
- 對 10 月 1 日起新建或 reassess、或 2027 年 2 月 1 日起 renewal 的 plan，核對參與者具體 plan 和官方 exclusions；不要把兩個類別寫成所有基本支援統一削減，並追蹤高支援需要 variation pathway 而不承諾結果。

使用邊界
本更新依據 2026 年 9 月 23 日查閱的 Federal Register 和 NDIA 資料，把已生效條文與後續階段分開。Section 45B 只適用於 8 月 27 日或之後提出的 claim，並且只涉及 NDIS Rules 指定、與該 claim 或該 claim 所涉 support 有關的記錄。對服務商，預設保存期由 claim 提出日起計為 7 年，但 Rules 可規定較短期限；這並不是所有 NDIS 文件一律保存 7 年。plan reassessment 的 90 天決定期由 NDIA 收到符合要求的表格、資料以及證據時開始，和 12 月 1 日起實施的 90 天 claim 提交期限是兩回事。budget 變化按參與者和 plan 情況適用，包含公開 exclusions，不是 CaresLink 的 funding calculation 或 review outcome。CaresLink 不判斷記錄、請求、plan 或 support 是否符合法律或資金要求，也不提供法律、監管、申報、定價、註冊或財務建議。
